Lucky Cement is the largest cement manufacturer in Pakistan and its upcoming expansion in Karachi will take its capacity from 6. 5mntpa to 9mntpa, further cementing its spot as the market leader. Lucky Cement Limited was incorporated in Pakistan on September 18, 1993 under the Companies Ordinance, 1984 (the Ordinance). The shares of the company are quoted on all the three stock exchanges in Pakistan.The Company has also issued GDRs which are listed and traded on the Professional Securities Market of the London Stock Exchange. There was a slight dip in the year 2010, but then increased considerably in year 2011. This was mainly due to the decrease in the cost of production for Lucky Cement (decrease in the cost of raw materials).The prospects of the company are bright, which are demonstrated by high net income margin and return on invested capital ratios. GROWTH PROFILE Lucky Cement is growing at a brisk pace, as the overall cement industry is facing a desirable scenario, which is also demonstrated by high return on equity and return on assets ratio. The company is also paying its creditors back shown by the decrease in leverage and debt to total capitalization ratios, which is a positive sign for the firm, and shows that it is growing at a considerable rate. RETURN ON INVESTMENTThe return on investment of Lucky Cement from years 2008-2011 is above 10% on average, which is quite a decent number, and shows the profitability of the firm’s investments. It is 12. 63% in year 2011, and displays a favorable scenario for Lucky Cement. CREDIT PROFILE The credit profile of the company shows a positive sign as the firm’s debt to total capitalization ratio declined from 45. 51% in year 2008, to 32. 60% in year 2011. The Attock Cement project was conceived and the company was incorporated in 1981, the plant finally commenced commercial production on Jun e 1, 1988. The project is a Pak Saudi joint venture and involved initial capital outlay of around Rs 1. billion with foreign exchange component of around US $ 45 million. This made it one of the largest enterprises in the private sector. Pharaon Commercial Investment Company Limited holds 84. 06% of total paid up share capital whereas the general public holds a total of 15. 94% shares. The company’s gross profit mar gin was very low as compared to that of Lucky Cement, however, the firm’s net profit margin is at par. It can be seen that Attock Cement has more operating expenses as compared to Lucky Cement, which it needs to cut and achieve efficiency, to match with the profitability performance of Lucky Cement. GROWTH PROFILE Attock Cement has a very fluctuating, or rather, a very inconsistent growth rate, as can be seen by the return on equity and return on assets ratios.Both the ratios were fairly decent in the year 2008, but then both saw a decline in consecutive years 2009 and 2010, after which they came back to an acceptable level in year 2011. RETURN ON INVESTMENT The return on investment of Attock Cement was again very unpredictable, fluctuating drastically between years 2008-2011. It touched a very high 32. 07% in year 2009, but then declined to a level which was similar to that in year 2008. Overall, the return on invested capital was at a satisfactory level as compared to Lucky Cement, which shows the positive nature of the company’s investments. CREDIT PROFILEThe credit profile of Attock Cement is a fairly acceptable one, as can be seen by the decreasing leverage and debt to total capitalization ratios. This means that Attock Cement, like Lucky Cement, is also paying back its creditors and suppliers, which will mean that the lenders will be happy to lend money and raw materials to the company, as they’re able to meet their financial obligations effectively. Khan Cement Company Limited (DGKCC), a unit of Nishat group, is the largest cement-manufacturing unit in Pakistan with a production capacity of 5,500 tons clinker per day.It has a countrywide distribution network and its products are preferred on projects of national repute both locally and internationally due to the unparallel and consistent quality. DG Khan Cement is paying a hefty amount as interest expense, which can be seen by the lower net income margin ratio of the firm, ranging from 0. 4-2. 46%. However, the EBIT and EBITDA margins of DG Khan Cement were quite satisfactory, and at pa r with the other two companies in the industry. GROWTH PROFILE DG Khan Cement has a very poor growth rate, evident by the very low return on equity and return on assets ratios. The growth of the company is badly hampered by the interest expense and the debt the firm has taken. Furthermore, the debt to total capitalization ratio of the company is also very high (higher than the other two companies in the industry), which was more than 50% in year 2009.These are negative implications for the company, and the investors must be unhappy with the performance of the firm. RETURN ON INVESTMENT: The return on invested capital for DG Khan Cement was also quite inadequate when comparing with that of Lucky and Attock Cement. It was 2. 39% in year 2008, increased to 8. 55% in year 2009, after which it settled on a level between 3-4% in years 2010-2011. This adversity was again due to the high debt ratio and hefty interest payments made by the company, because of which the return on investments w ere very low as compared to its competitors.CREDIT PROFILE: As opposed to its competitors, DG Khan Cement has a really horrific credit profile, as it is maintaining its debt to total capitalization and leverage ratios at a very high level and took up more loan in the year 2009, due to which its profitability is also getting affected adversely, and also its creditors and suppliers will be unwilling to lend DG Khan Cement more in the future, doubting the firm’s ability to pay them back, as it already has outstanding amounts to be received from the company. The company needs to increase its growth by retaining more than half of its earnings and re-investing it to increase its income in the coming years otherwise it will fall way behind the industry and would take a long time to recover. RETURN ON INVESTMENT The return on investment has improved from the prior year.This implies that company is capitalizing its assets in a more efficient manner with an increase in the accumulated profits. However, it is not at all satisfactory in comparison to its competitors. CREDIT PROFILE: The debt to capitalization and leverage ratio is very high which means Fecto has more debt as compare to its equity. It has declined from the preceding year but it is fairly high with regards to its competitors. This shows a weak financial position as compared to the industry and poses more default risk for the company. MAPLE CEMENT A t the time of privatization in 1992, the capacity of Maple Leaf to produceOrdinary Portland Cement (OPC) was 1000 tones per day (tpd). A second plant of 4000 tpd was commissioned in 1998 and a third plant of 6700 tpd came into production in 2006. It increased the total capacity to 11,700 tpd. The capacity of White Cement has also increased from 100 tpd to 500tpd with the addition of a new plant. This plant also has provisions for doubling the capacity to 1000tpd. Presently Maple Leaf cement has 9% of the market share of OPC and is a leading brand in Pakistan with a diverse customer base. This means that the company needs to increase its sales in order to get a favorable outcome in the coming years. CREDIT PROFILEThe leverage ratio as well as the debt to equity ratio is fairly high as compare to the industry which refers to declining operational efficiency and ineffective asset management. Maple needs to decrease its reliance on debt to get a better ratio in the coming years. There is also an increase in the distribution cost which is due to the increase of appreciation in exports related freight and other charges which increased by 11. 61% despite of decrease in sales volume of export by 18. 3%. RETURN ON INVESTMENT: The return on invested capital is same as the previous year which is fairly high as compare to the other companies. This means that return from investments is considerably more than the industry average. CREDIT PROFILE: The credit profile of the company is not much satisfactory. Moreover, the leverage ratio of Thatta Cement has also seen a decline, which shows that the company is paying back its debts and is maintaining a decent credit profile among its lenders and suppliers

Kohlberg and piaget’s moral development

Elizabeth, a seven year old child, was forbidden by her mother to play inside the house or else she’ll tie her up side down.   One day, her little friends invited her to play a â€Å"chasing† game.   Ã‚  Because she was not to play inside the house, she told her friends to play outside the house.   They got bored with the game and decided to change it into hide and seek.   Elizabeth, a very competitive child, doesn’t want to be caught by anyone.   She decided to hide inside the house keeping in mind to be as careful as possible.But unfortunately for her, her friend Aspen, who was the seeker, saw her enter the house and followed her.   Elizabeth got nervous when she saw Aspen.  Ã‚   In the instant that Aspen entered the house, Elizabeth quickly ran towards the door but she was caught by Aspen.   They grab each other so that one of them might reach the base first.   But as they grab each other they bump into vase stand.   The vase fell and break s. Her mother caught them.   Elizabeth told her mother that it’s not her fault and include Aspen as well.Commonly, children exhibits a pre-conventional level of way of thinking, that is,   they enter the first and second stage of Kohlberg’s six stages of moral development   (Nucci, 2002).   In stage 1, children conceived an action to be right or wrong according to the punishment their parents give them.   In stage 2, the concept developed by a child is like â€Å"you scratch my back, I’ll scratch yours†.  For Piaget, children are more worried about the results and consequences of what they have done rather than the true reason underlying their action (Nucci, 2002). Applying these theories to Elizabeth’ situation, she would think of horrible situations like her mother’s going to tie her up side down.   Maybe she’ll also think of different scenarios like she’ll not allow her to play ever again.   Another thing, sh e’ll make sure that Aspen will take her punishment too – this is to include the â€Å"you scratch my back, I’ll scratch yours†.  Ã‚   Obviously, the child’s age is appropriate to the stage since Elizabeth is exhibiting both the characteristics that Piaget and Kohlberg described.ReferenceNucci, L. Chirnside v Fay

Chirnside v Fay I Introduction On 6 September 2006 the Supreme Court released its important and controversial judgment in Chirnside v Fay . Elias CJ and Tipping and Blanchard JJ took very different approaches to the issue of whether or not to grant an equitable allowance to the defendant. This essays primary aim is to provide a detailed description of their Honours differing opinions as to that issue and also outline the authors own opinion as to what approach should be adopted. This essay starts with a brief description of the fact situation and the general law behind equitable allowances. It then describes the differing approaches taken in Chirnside . Next, the author makes a principled argument that the broad approach should be preferred when considering whether or not to grant an allowance. II Analysis of Chirnside v Fay A Fact Situation The plaintiff, Mr Fay (MF), and the defendant, Mr Chirnside (MC), were both property developers. They had known each other since the early 1980s and in 1997 decided to enter into a project together in respect of an old building. They had Harvey Norman (HN) in mind as the potential anchor tenant. Although MF made the initial contact with HN MC became almost solely responsible for dealing with them and entered into a conditional contract in his name only. HN made the final commitment to the project on 7 July 2000. By that time MC had gone cold on MF, largely due to his limited involvement. Instead of telling MF this MC intended to complete all the transactions through Rattray Ltd while convincing MF that he himself was no longer involved. MF argued that there had been a partnership and that he was entitled to proceeds, which was denied by MC. The project was ultimately completed. MF sued. By the time this case got to the Supreme Court the only viable cause of action that MF had was breach of fiduciary duty. The Supreme Court was unanimous in finding that MC had breached his fiduciary obligations. B Equitable Allowance There is a presumptive requirement that once a breach of fiduciary duty has been established the errant fiduciary must disgorge all profits made by dint of the breach. That is commonly referred to as the no-profit rule. There are two main exceptions to that rule. The first is where there has been some antecedent agreement for profit sharing. The second is where the court decides to exercise its discretion to grant the errant fiduciary an allowance for their skill, labour or expertise in making the profits. The onus is on the defendant to satisfy the court that an allowance should be made. In Chirnside there was an antecedent profit-sharing arrangement between the parties. Because of that agreement MC was entitled to a deduction of 50 per cent to the amount he had to account to MF. In addition to that, MC argued that he was entitled to an allowance due to the effort he exerted in gaining the profit from the joint venture. There were two different approaches taken to this issue both in regards to the actual law itself and the application of it. 1 Elias CJ Elias CJ took a strict approach to the issue of when an allowance should be granted. Her Honours main point was that allowances should remain exceptional, as Lord Templeman and Lord Goff in Guinness Plc v Saunders suggested they should be. She expressed the view that an allowance should generally only be permitted if the fiduciarys breach was wholly innocent and the beneficiary was-wholly undeserving, as in Boardman v Phipps . She accepted, however, that there had been cases where allowances had been granted despite the fiduciary not being blameless. She was of the opinion that the allowances were granted in such cases due to the fiduciary creating extraordinary profits outside the scope of what was envisaged in the fiduciary relationship while not having committed any significant wrongdoing. To evidence this point she analysed the cases of OSullivan v Management Agency , Estate Realties v Wignall , Badfinger Music v Evans , and Say-Dee v Farah Constructions . She suggested that in t hose cases the fiduciary had created substantial and unexpected profits and in most of them the wrongdoing was mere non-disclosure, which supported her proposition. Thus, she was of the view that an allowance could only be granted here if MC could show that he was wholly innocent and MF was-wholly undeserving or that he created extraordinary profits, essentially outside the scope of the fiduciary undertaking, while not having committed any significant wrongdoing. She then applied that reasoning to the facts. She held that MC had committed significant wrongdoing because by actively concealing his breach of duty at a vital time he had directly undermined the obligation of loyalty which is the cornerstone fiduciary obligation. Moreover, she was of the opinion that the work which MC had done was expected of him and thus was within the scope of the joint venture giving rise to the fiduciary obligations. Based on those two findings she denied MC an allowance. She did, however, make two additional points. Firstly, she saw no significance in the fact that MCs work had been undertaken before he had committed the breach because he was required to account for all profits made through the opportunities he obtained as a fiduciary which covered the whole joint venture. Secondly, the fact that MC was entitled to a 50 per cent deduction by dint of the antecedent agreement was important to her because she felt that if an allowance were to be granted he would essentially be receiving the full benefit he might have expected had he been wholly loyal which would significantly undermine the obligation of loyalty. 2 Tipping and Blanchard JJ Tipping and Blanchard JJ took a broad approach to the issue of when an allowance should be granted. They expressed the view that what a court should consider is whether, on the overall balance of the equities between the parties, it is fair and just to grant an allowance. In considering that, all the relevant circumstances must be taken into account. The essence of this exercise was to come to a fair conclusion as to what the fiduciary had to account. Thus, unlike Elias CJ they were of the opinion that the significance of the defendants breach and the personal input that they put into creating the profits were only factors to be taken into account rather than criteria that had to be satisfied. However, they did emphasise the need for restraint when calculating the amount of an allowance. That is, they expressed the view that the amount of allowances should generally not be liberal in order to deter others from committing breaches of fiduciary duty. Their main authority for this appro ach was OSullivan , Warman International , Estate Realities , and Murad v Al-Saraj . They analysed Saunders , which was a crucial case for Elias CJ, and distinguished it based on the finding that the obligations in that case were expressly accepted whereas in this case the obligations were imposed. They stated that it would be unfair and conflict with the pillars of equity to apply such a strict approach as was done in Saunders in a case such as this. They then applied that reasoning to the facts. There were four key factors which led to them ruling that it was fair and just to grant MC an allowance. Firstly, they held that MCs breach was not significant because it was not fraudulent or dishonest and MC genuinely believed he was entitled to act as he did. Secondly, they held that most of MCs work was done prior to his breach of duty and as such the breach did not facilitate in any way the making of the relevant profit. This was relevant to them because due to that ruling there could be no suggestion in their minds that by granting an allowance the fiduciary relationship would be undermined by encouraging fiduciaries to act in breach of duty. Thirdly, they held that MC had contributed far more effort in bringing the joint venture to profit than MF. In particular, MC had incurred all legal and financial liability and engaged in most of the negotiations with HN on his own. Fourthly, had the project been completed with MF then it was clear that he would have agreed to recognise MCs disproportionate contribution in a reasonable way which would have probably included an element of disproportionate profit sharing. Having found that an allowance was suitable they then exercised restraint in calculating the amount of the allowance, which they ultimately considered to-be $100,000. 3 Conclusion Thus, the key distinction between these two approaches is that while Elias CJ believed it was necessary to keep allowances exceptional by adopting a strict approach based on general elements Tipping and Blanchard JJ considered the issue by asking a much broader question based on notions of fairness. III Authors Opinion as to the Appropriate Approach to Allowances Every court of equity has the broad aim of doing justice between the parties. Indeed, equity was originally developed in order to address the injustices that resulted from the strict application of common law rules and since then it has been consistently stated that equitable remedies must be fashioned to fit the nature of the case and its particular facts. It would be more consistent with these broad goals for the decision of whether to grant an allowance to not be based on general rules but rather on an overall assessment of the particular facts and the merits and claims of the defendant. That is because a court is much more able to come to a decision that is fair between the parties if it is able to take account of all the circumstances of the case and not be limited to discussing a couple of general issues as courts that adopt the strict approach are. While the major issues in deciding whether to grant an allowance will often be the moral blameworthiness of the defendant and the personal input that they put into creating the profits, which are the two issues addressed under the strict approach, there are other important issues that can only be properly taken into account under a broad approach. For example, the circumstances in which the breach occurred , the circumstances in which the gains or profits were derived , the beneficiarys reliance on the fiduciarys involvement in the arrangement , and the extent to which the defendant has already been compensated through professional fees . The case of Chirnside illustrates this point that in taking a broad approach the court is more likely to come to a decision that is fair and just. In Chirnside it was clear that although the plaintiff had breached his fiduciary obligations it would be unfair if he was not granted an allowance. That was because the defendant had almost singlehandedly brought the joint venture to profit and the plaintiff was originally going to compensate him for his significant efforts. Elias CJ took a strict approach to the case and due to its rigid nature she was unable to do justice between the parties. However, in taking a broad approach the main judgment was able to take account of all the circumstances and reach a fair and just decision. Thus, courts should use the broad approach because they will be more able to reach fair and just decisions and be more in line with foundational aspects of equity. Furthermore, a broad approach is more consistent with the important equitable maxim of he who seeks equity must do equity. That is, under a broad approach the court will always be able to recognise whether the profits to which the beneficiary is entitled are in the nature of a windfall and as such rule that the beneficiary should provide some recompense for the work that has produced it because equity is not in the business of unjustly enriching plaintiffs. Furthermore, the broad approach is a lot more flexible than the stricter approach and as Tipping J stated in Chirnside it is undesirable to adopt rigid equitable approaches unless the justification for such an approach is compelling. The reason for that is that one of the foundational aspects of equity was its remedial flexibility in that it was first developed to address the rigour and rigidity of the common law. The way in which one typically makes such an argument is to suggest that the rigidity of the stricter approach tends towards much greater certainty, which is particularly desirable due to the significant vulnerability and broad liability involved in the application of the approach, and as such it is necessary in the overall interests of justice to adopt a rigid approach. In this case, while adopting the stricter approach would create more certainty it is not particularly important to do so here because the burden of proof is on defendants who will have breached some of thei r obligations and allowances are usually modest. Accordingly, there is no compelling reason in this regard to adopt a stricter approach. An argument that is frequently postulated in favour of a stricter approach is that such an approach will be more effective in deterring fiduciaries from acting in breach of their duties. It seems farfetched to suggest that a defaulting fiduciary will not engage in certain behaviour for fear that it will be unremunerated. Indeed, many cases show that a fiduciary will engage in conduct in breach of duty regardless of the potential sanction. Moreover, if equitys true goal was deterrence then a defaulting trustee would not be allowed to retain a proportion of the profit made from acquiring an asset with mixed funds. Also, courts that adopt the broad approach still pay regard to this concern by exercising restraint when they calculate the allowance. Thus, it seems unsound to not adopt a broad approach based on notions of deterrence. It is sometimes argued that allowances should never be granted because the making of an allowance means that there is no sanction for the defendants conduct. This argument is ill-conceived. The purpose of an allowance is to properly fix compensation or damages on the basis of disgorgement of profits properly analysed, not to apply a sanction or punishment for the breach of duty. Conclusion In conclusion, it is clear that the approaches taken by Elias CJ and Tipping and Blanchard JJ are very distinct and will reasonably frequently lead to differing results, as in Chirnside itself. It is this authors opinion that the broad approach used by Tipping and Blanchard JJ is the more appropriate approach because it is more in line with foundational aspects of equity and the arguments in favour of the strict approach are not compelling enough to go against that. Given the main judgment in Chirnside , and Estate Realities , it is likely that the broad approach will be used in New Zealand for the foreseeable future.

Coming-of-Age Stories with Morals: T. Coraghessan Boyles Greasy Lake a

T. Coraghessan Boyle's "Greasy Lake" and John Updike's "A & P" have many similarities as well as differences. Both are coming-of-age stories that teach some sort of lesson to the protagonist at the end. â€Å"A&P† is about a nineteen-year-old boy who stands up against his manager to impress a couple of girls who are dressed â€Å"immodestly†. â€Å"Greasy Lake† is about many nineteen years olds playing a prank on a couple of bad characters who turn out to show the teens what they can really do in return. Luckily, the narrator and Sammy both realize their deficiency after the situations with the other characters. In â€Å"A&P† the narrator’s turning point in his life is when he finds the bikers body in the lake next to him. Executive Summary In 1974, Berkshire Toy Company (BTC) was founded by Franklin Berkshire, Janet McKinley’s farther. Janet was soon became the CEO of the company when her father retires on 1993. This is due to the price discounts of 7 to 10 percent of the three main inputs of the product namely acrylic pile fabric, plastic joints, and polyester fiber filling which contributed to some savings. However, the actual quantity used in production is greater than the standard quantity allowed per unit that results to unfavourable material usage variance. This maybe because of substandard quality of materials used that more materials are needed to produce one unit of product. In addition, there was an incident of thunderstorm that ruined the uninsured materials wherein the company doesn’t able to recover large amount of fiber filling. Another factor that would affect the direct material usage variance is the lifetime guarantee that the company offers which include the bear hospital since repairs or replacements of teddy bear are free. Also, defects may be a factor for the material variances which are only traced after the production process. Direct Labour variance The actual number of hours used and the actual wage rate of BTC are higher than the standard rate allowed for the actual production. Since most part of the production of bear is labor-intensive, the company may have set a low standard for the number of hours required to produce a unit. Additional sewing steps and inspection of the fabric color may have contributed to the actual labor hours used. Moreover, shortages of length in the cutting stage may require additional cutting set-ups which increase production time. Considering the production of the company, they have operated near to maximum capacity that the people are tired and some of them quit and had to be replaced at higher-than-standard wage rates that may lead to higher cost when unskilled workers are employed. Variable Overhead Due to the effect of the increased in labor requirements, the company also incurred increased payroll taxes and fringes. Employees need to have overtime to meet the actual demanded product volume which is higher than the budgeted that consequently increase the overtime premiums paid by BTC. Since the company has been using the same machine since it was established, frequent breakdowns occurred that maintenance work have contributed to the increase in the variable expenses. The figures of sales may post a good performance conversely the current sales might give the lowest possible sales due to wrong sales mix. The marketing department has focused too much on the Internet Sales whereas it gives a lower contribution than the Retail Sales. Variances in the production of the product are due to the wrong focused of the department head because of the new incentive compensation program. Favourable direct material price variance occurred due to lower prices and discounts on the materials purchased. However, unfavourable material usage variance have occurred probably due to substandard materials were used to the production. Direct labour on the hand, have resulted to unfavourable variances on both efficiency and rate. Focused of the manager may be on the efficiency of labour due to the incentive program which gives the need to hire more skilled workers. This resulted to unfavourable labour rate variance. However, due to substandard materials were used the workers may have needed additional time to work on the teddy bears which still resulted to unfavourable variance. The incentive program may have good intentions but this lead the department heads on the wrong direction and have resulted to unfavourable variances. Other factors that may have affected the variances are the spoilage due to the thunderstorms that have occurred. Machine maintenance is another factor especially in the overhead variances where frequent breakdowns happened. Alternative solutions obtain First solution that we recommend is the revision of the incentive compensation plan. The objective of the plan is good and should be maintained however some computation for the said bonus should be changed. Computation of Bonus for the Marketing Manager could be retained as net revenue is a good measure not only in the performance of the marketing department but as well as the performance of the company. Computation for the Purchasing Manager should have also considered the Material Usage Variance as quality of the materials purchased in also a key factor in their production. Bonus for the production manager may have been a good computation as it may have covered different factors to assess the performance of the department. On the other hand, some overhead expenses should be observed by the company  as it continuously increase overtime. They may need to consider purchasing new machine as maintenance cost has been a big part of their cost. A new machine may also address the issue of frequent overtime of employees and the increasing maintenance supplies expenses.

Analysis of Language, Rhetoric, and Politics in George Orwell’s 1984 Essay

This statement coming from the novel entitled Nineteen Eighty-Four by George Orwell contains different meanings depending on its context and rationality. The phrase â€Å"war is peace† can be define as a prediction or conclusion that peace is always a result of war. When there is war, there would be peace, which is not always true depends on the situation. The phrase â€Å"freedom is slavery† can be said that even if you are free, there are influences, consequences, and contributors that would continue the act of slavery and people would still suffer from these cases. Because when we say freedom, there would be a form of governance and democracy but as long as authority exists, slavery would still become part of freedom. The phrase â€Å"ignorance is strength† can be true sometimes. If you are ignorant, you are more capable of acting without losing anything because you do not know something. Ignorance can be said as an escape to do everything without knowing anything – just to be free. However, why do these phrases were stated if they could actually say what is true and correct without any vague, ambiguous, and doublespeak words or languages. Use of languages can be vague and ambiguous depending on the person who used it, on the context he is relating with, the people he is talking to and the meaning of those words itself. Most often, we use words that are light but critical in order to make our audience or the person we are talking with will be less burdened by the whole situation. We use fuzzy, confusing and light words to exemplify the meaning of what we need to say in accordance to their feelings. One of the practical or simplest examples is the words or languages in business. A corporation needs to reduce its employees due to company problems, but rather than using honest words – they utilized technical words in order to make their employees understand the situations (not the real reason) with no hard feelings or at least minimal objection coming from the employees. One company denied it was laying off 500 people. â€Å"We don’t characterize it as a layoff,† said the corporate spin doctor. â€Å"We’re managing our staff resources. Sometimes you manage them up, and sometimes you manage them down. Firing workers is such big business that there are companies whose business is helping other companies fire workers by providing â€Å"termination and outplacement consulting† for corporations involved in â€Å"reduction activities. † But don’t worry, if you’re â€Å"managed down,† the â€Å"Outplacement Consultant† will help you with â€Å"re-employment engineering. † (Lutz, 1996) Because of these scenarios, people became clueless rather than being educated that are actually needed in every aspect of human life. In order to become productive, we need to be sophisticated by the fact that we need to understand things that are connected to our jobs, sociological interaction, or even personal maters. However, there are instances when these aspects of understanding and education could not be obtained because people behind those conflicts and problems are apprehended by their actions. Therefore, it is a form of stealing – stealing our learning, knowledge, and privilege to recognize sensitive matters. That is why people having these issues are playing-safe to acquire less refusal or conflicts in the future but the consequences will be more problematic. Then, a question will rise towards these issues as it become more active during these times. The question will be what are the grounds of these people to state ambiguous, vague, and doublespeak that are more conflicting rather than honest thoughts? I guess, the reason why these things happened is that people are inherently liar in different forms and grounds as also based on the article of Stephanie Ericsson entitled, The Ways We Lie. Why do they need to do these? It is because they need to compel people that there is no problem or everything is all right to extent of lying just to make things better. We lie. We all do. We minimize, we avoid confrontation, we spare people’s feelings, we conveniently forget, we keep secrets, we justify lying to the big- guy situations. (Ericsson, 1992) This statement shows that we all lie in different situations especially when it is needed or sometimes we used words that are less offensive to minimize the reaction of our audience or who we are talking with. In this case, as connected to the phrases above, use of doublespeak, vague, or ambiguous words are already part of our sociological interaction. We are doing this in order to make the people less objective to the whole situation. However, we cannot deny the fact that it will soon emerged into a conflicting issues that needs to be done in accordance to the law. Coming from the novel Nineteen Eighty-four by Orwell the statement â€Å"robbing its citizens of their capacity for critical thought and reasonable, authentic self-expression† is true not only from the past but also in the present and will still exists in the future. It is a fear we too, in our modern society, must share, or argue that his fear is exaggerated or even unfounded. Because of the cases that were explained above, people could not be able to express themselves because hey are becoming ignorant to what is true and right. I can say that it is better to recognize the truth despite of the failure that it may cause rather than doing some actions and hoping that there would be a brighter future but actually, there would be no solution to the problem is more miserable. Our political, social, economic, and even personal aspects of living are full of doublespeak words and languages. This is because we are not always open to reality and truth for we do not want to be rejected, obligated, and failure. Most often, we keep on hiding from our blankets to escape from the certainty of everything. That is why, in order to minimize these cases, people are already doing lesser projections to reduce absurd feelings that may cause tension and despair. However, does political aspect needs these cases to magnify the burdens of the future. Logically, we know that political cases and aspects should be honest when it comes to its decision, preferences, and problems because its citizens are the primary affected from all of it. Nevertheless, this is not the situation today. There are some situations or maybe almost problematic situations that are hidden from the knowledge of the people for it will bring terrible conflict to the country. If the government could not control the situation and people knew about it, the president or the leader will explain but it will use doublespeak words or languages to make the people more comfortable and to lessen their fright, but up to what extent? Things like these happened after the September 11, 2001 attack in New York. The president claim that the country is already safe from terror attacks but he did not state any problem after the terror attack. He used doublespeak words to make its people less frightened from the whole situation but he did not say anything about the defenseless cases and problem within the white house that the terrorists already warned them but they did not pay attention to it. In this case, they did not want to be blamed so they made some segues and focused on the future having no further justifications of the past and the present. In our time, it is broadly true that political writing is bad writing. Where it is not true, it will generally be found that the writer is some kind of rebel, expressing his private opinions and not a â€Å"party line. † Orthodoxy, of whatever color, seems to demand a lifeless, imitative style. The political dialects to be found in pamphlets, leading articles, manifestoes, White papers and the speeches of undersecretaries do, of course, vary from party to party, but they are all alike in that one almost never finds in them a fresh, vivid, homemade turn of speech. As a whole, Orwell’s novel is a revelation of the past situations that still exists today. Language is not a problem but the people who used the language based on their intentions and desire. If they choose not to be obligated and responsible to the problem, they will use doublespeak words, but if we think of it, who will be responsible for all of those problems if no one is honest about everything? Is it the future generation, or our ancestors?

La Grande Odalisque and Olympia: Comparison/Contrast

Two exquisite paintings with a female reclining nude as the focal point are La Grande Odalisque by Jean Auguste Dominique Ingres and Olympia by Édouard Manet. The female nude has been a crucial subject for art throughout history.   The angular curves and the sensuality that can be created with just a form has intrigued artist in the past, present, and future.   While the similarities of these two painting are more evident, there are still contrast between the pieces. Ingres was from France and he painted during the Neoclassical Period, while Manet, who was also from France, painted during the Realism and Impressionistic Periods.   Their live overlapped each other for only thirty years, but their styles belonged to different periods.   Ingres lived through the French Revolution and was very much affected by it although Manet was born after it was over. Seeing such a drastic change in the world in which he lived caused Ingres to pay very close attention to the details of the past.   He wanted to preserve it perfectly and he also looked to the techniques of the masters before him.   Manet was not so much concerned for the past, but his eyes were on the present.   His subjects represent the French societal and cultural setting of the time period in which he lived. La Grande Odalisque by Ingres is an oil painting of a lone nude female reclining on her bed.   Her body faces away from the viewer, while the woman looks back over her shoulder.   There is only a glimpse of her breast under one of her arms and the rounded sides of her buttocks are visible. Olympia by Manet has two females in the oil painting.   One is a black servant woman and the reclining female nude.   Manet depicted his nude facing the viewer.   Her breasts are completely exposed and her genitals are covered by her hand. There is a tropical feel in Manet’s painting  Ã‚   Even though she has covered part of herself, this female seems more open with her nudity and the female in Ingres’ painting is more subtle and alluring with her body. Ingres uses muted shades of green jewel tones to create an elegant effect.   Manet also incorporates the color green, but he emphasizes the stark white which allows the female to stand out.   The white also gives a harshness to the painting.   It is as if someone turned on a bright overhead light in the middle of a sensual moment.   The model in Ingres’ painting tends to blend with her surroundings. Both females hold something with her hand, but Ingres’ female’s fan is one of peacock feathers which blends in with the rich tones of the background.   At the barefoot of Ingres’ nude, there is a pipe and green stool, while there is a black cat at the high healed feet of Manet’s.   Manet’s figure wears an orchid in her hair as well as the shoes.   She finds no modesty with the observation of her servant’s stare and is completely open with her sexuality. The female nude is the predominate subject of both paintings but the differences reflect their artist and there artistic periods.   While they are both alluring, they are also starkly contrasted.   Manet and Ingres were definitely masters of their times, and the La Grande Odalisque and Olympia are examples of both of their best work.   Both of these works are alluring and sensual paintings that will mystify viewers as long as the two works exist.

The Self-managed Learning Context Many researches over the years have been showing the self- managed learning is getting very popular inside organization, based on the benefits that an individual acquires at the end of each achievement. Individuals that can manage their learning and activities are more responsible, independent and able to make tough decisions. Self-planning learning; selfeducating; self-directed learning and other similar terms together form the Self-managed context, in other words, the ability to organize and carry out an activity settled as a goal. 2.1 Self-Directed Learning In the early age, individuals are full dependents on the structure and the context given by their tutor, responsibility here is very low. A child needs to have some task to be accomplished, the tutor has to explain why and how tasks should be done. At the teenage stage the individual starts to be interested in their  own learning, the tutor give them more  space to be responsible. A simple example, when starting college they have the possibility to choose some subjects they would like to study deeper than the others. Once reached mature life the role tended to change. The adult pass to be self-directed learner, deciding what will be their own goals according with their needs. At this stage the tutor can be only partial responsible in the process of learning, showing them how important is to become a „SelfDirected Learner‟, encouraging and guiding, also stimulate the individuals to think outside the box, always to seek for evaluation on everything that they do, letting the participants dedicate their time on researches and experiments. The process helps the learners understand how to achieve their goals. The practice involves training and lifelong acquired skills. The self-managed learning starts when people show initiative to conquer some learning experience, being fully in charge for the learning and practicing constant evaluation to succeed. Determination; time; place; tools; evaluation; responsibility, are extremely important elements that a person must consider to be successful. We can find these factors in Malcolm Knowles‟s theory definition: â€Å"In this broadest meaning, ’self-direct learning’ describes a process by which individuals take the initiative, with or without the assistance of others, in diagnosing their learning needs, formulating goals, identify human and material resources for learning, choosing and implement appropriate learning strategies, and evaluating learning outcomes.† (Knowles, 1975) The process of self-directed learning can be different based on the lifelong circumstances. All the tools, method, structures, conditions for learning  are directed by the situations (Merriam & Caffarella, 1993). People learn things in different ways and speed, with their own or other people‟s experiences. It can depends on where it will be applied (e.g. at home, at work, study group, etc.); what tools will be used (e.g. books, internet, videos, etc.); whom is going to perform the task. It can be formal and informal. The self-directed learners after conquering their aims, starts to be more aware of their responsibility in taking learning seriously and directing themselves (Garrison, 1997). They become more creative, curious and the willing to try something new, different (Lyman, 1997), Problems and difficulty to complete a task are seeing as fun challenges (Taylor, 1995). Based on Taylor‟s point of view, the S-D Learners are motivated and persistent, independent, self-disciplined, self-confident. 2.2 Self-Regulated Learning It is a reference to â€Å"thoughts, feelings and actions that are planned and adapted to the attainment of personal goals† (Zimmerman, 2000). The components of S-RL involves, as all the other terms, setting goals for learning, focus on training, using strong strategies to organize ideas, looking for researches effectively, managing performance and time, holding positive beliefs about one‟s capabilities (Schunk & Ertmer, 2000). There are tasks that makes Learners more autonomous, being capable of create an environment of S-RL, some of them are authentic strategies, autonomy-based assignments, and portfolios. Self-Regulated Learners don‟t only need to understand the strategies but realize the importance of using them to achieve success. Self-Regulation processes focus on how learners can manage their feelings and motivations to learn. It can be improve with practice. However, stresses related with low income such as psychological distress on adults and low quality of childcare background can harm the development of the individual, like occupational rank inside the organizations. Self-control is one of the most important key/skill to success inside any organization, also in the personal life. 2.3 Self-Planned Learning The term says for itself. Here we can find some procedure to put on practice SML: Selecting a subject or skill to learn, first evaluating knowledge acquired, seeking for weakness and errors that can be improved. Selecting methods, resources or equipment for learning  S-M Learners thinks they would be wasting time by letting the responsibility on somebody else to manage the time for each task. No wrong time and location, the learners will be available whenever/wherever there are. Expect to feel proud for accomplishing the task and get people attention. The purpose of this exploration was to expose students to the potential of typographic solutions inspired from the everyday. I found each experiment to be equally inspiring. I have always been enchanted with simplicity. I think that it is the obvious which is overlooked. The materials at the 99 cent stores are consistently looked at as if they are throw-aways but imagine if an alphabet based on simplicity could work as a language for those who suffered from visual diseases. Working with the simple objects reminded me of what the original purpose of language is. We use language to communicate with others, and it think that it can be said that the majority of cultures somehow find their way into 99 cent stores, thus the culture has common elements as it is. Inventing a language from the items merely takes my concept to the next level. When we look at Chinese, Japanese and Egyptian lettering, we see beautiful art forms. The same very much exists in my project.
